End-User License Agreement
This EULA is a legal agreement between you and ZAHN Management UK Ltd governing your use of the ZAHN mobile application and any related services, features, or updates. By downloading, installing, or using the App, you agree to be bound by this Agreement.
Subject to your compliance with this Agreement, ZAHN grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable licence to:
- Download, install, and use one copy of the App on a mobile device that you own or control
- Use the App solely for your personal, non-commercial purposes
No rights are granted to you other than those expressly stated in this Agreement. Continued use of any updated version of the App constitutes your acceptance of the then-current version of this Agreement.
You agree that you will not, directly or indirectly:
- Copy, modify, adapt, translate, reverse engineer, decompile, or disassemble the App
- Attempt to derive the source code of the App or any part of it
- Use the App to build, develop, or operate a competing product or service
- Remove, obscure, or alter any copyright, trademark, or proprietary notices
- Circumvent, disable, or interfere with security-related or technical features
- Use the App for any unlawful, harmful, abusive, misleading, or fraudulent purpose
The App, including all software, code, algorithms, interfaces, designs, text, graphics, branding, trademarks, and logos, is owned by ZAHN Management UK Ltd and/or its licensors and is protected by intellectual property laws.
This Agreement does not transfer ownership of the App or any intellectual property rights. You receive only a limited licence to use the App in accordance with this Agreement.
The App includes features such as live location sharing, Ghosting (temporary location pause), Saved Spots, and check-ins, intended to support personal safety and convenience.
The App is not an emergency service and does not replace law enforcement or emergency responders. If you are in immediate danger, call 999 (UK) or your local emergency number.
You acknowledge and agree that:
- The App does not guarantee personal safety and must not be relied upon as your sole means of safety in any situation
- Location data may be delayed, inaccurate, or unavailable due to technical, network, device, or third-party limitations
- ZAHN cannot guarantee that a contact has received, viewed, or acted upon any location share or check-in notification
- Network connectivity and GPS accuracy are outside ZAHN's control and may affect the reliability of the App at any time
- You are solely responsible for your own safety decisions
ZAHN may provide updates, upgrades, patches, or enhancements to the App from time to time. These may be installed automatically depending on your device settings. Updates are subject to this Agreement unless accompanied by a separate licence, in which case the separate licence will apply.
ZAHN reserves the right to modify, suspend, or discontinue the App or any part of it at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation.
The App integrates with third-party services to function properly. These currently include:
Third-party services operate under their own terms and privacy policies. ZAHN does not own or control these services and is not responsible for their availability, accuracy, security, or data-handling practices. To the fullest extent permitted by law, ZAHN disclaims all liability arising from your use of or reliance on third-party services. You are encouraged to review the terms and privacy policies of any third-party services you use.
Your use of the App is subject to our Privacy Policy and GDPR Privacy Notice, which explain how we collect, use, and protect your personal data, including location data. By using the App, you acknowledge and agree that your data will be processed in accordance with those documents.
This Agreement remains effective until terminated.
- By you: You may terminate this Agreement at any time by deleting the App and ceasing all use
- By ZAHN: We may terminate this Agreement or suspend your access if you breach this Agreement or if the App is discontinued
Upon termination, you must immediately stop using the App and delete all copies from your devices. Sections 3, 9, 10, and 11 of this Agreement will survive termination.
The App is provided "as is" and "as available." To the fullest extent permitted by law, ZAHN disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, and warranties that the App will be uninterrupted, error-free, secure, or accurate.
Your use of the App is at your own risk.
To the maximum extent permitted by applicable law, ZAHN shall not be liable for any indirect, incidental, special, consequential, or punitive damages, loss of data, profits, revenue, business, or use, or personal injury, distress, or property damage arising from use of the App. ZAHN's total liability under this Agreement shall not exceed the amount (if any) paid by you for the App in the twelve months preceding the claim.
Nothing in this Agreement excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, any liability that cannot be excluded under the Consumer Rights Act 2015, or any other liability that cannot be lawfully excluded or limited.
This Agreement is governed by the laws of England and Wales, without regard to conflict-of-law principles. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protection rights you may have under the laws of your country of residence.
If you have a complaint about the App, please contact us first at legal@zahnapp.com. We will acknowledge your complaint within 5 business days and aim to resolve it within 30 days. If we are unable to resolve your complaint, you may seek further resolution through applicable consumer dispute resolution services or the courts of England and Wales.
This Agreement is between you and ZAHN Management UK Ltd only. Apple Inc. and Google LLC are not parties to this Agreement and have no responsibility for the App or its content.
Apple App StoreYou acknowledge that Apple Inc. is a third-party beneficiary of this Agreement and, upon your acceptance, Apple will have the right to enforce this Agreement against you as a third-party beneficiary. ZAHN, not Apple, is solely responsible for the App and its content. Apple has no obligation to provide any maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App.
Google PlayYou acknowledge that Google LLC is not a party to this Agreement and has no responsibility for the App. Your use of the App via Google Play is also subject to Google's Play Store Terms of Service.
